TERMS AND CONDITIONS FOR IMPACT HQ LIMITED’S ONLINE OR IN PERSON WORKOUTS AND TRAINING PROGRAMS
1. Refund Policy
1.1 The Impact HQ Limited’s Online or In Person Workouts and Training Programs are delivered entirely as a service or digital product with no recoverability once it is delivered. Therefore, no returns are accepted. That said, we do stand by our product. We are more than happy to help you to get the most out of your program should you have any questions. Please just let us know how we can help by

2. Shipping And Delivery Policy
2.1 All products, workouts, and training programs are digitally distributed and available for immediate access and/or download upon payment. Alternatively they are a service provided in person. No physical products will be shipped.
PHYSICAL PRODUCTS TERMS AND CONDITIONS
4. Impact HQ Limited reserves the right to modify or change product specifications as required in order to improve our product range and availability. This will only be done when we consider the alternate product to be of equal or better quality. We recommend that you immediately inspect any product upon delivery to you to ensure that you are completely satisfied with the product, including that the product is of acceptable quality and matches the description of the product.
5. All products come with a 90-day warranty against breakage or manufacturing defect and a 30-day unconditional guarantee.
6. Requests for replacements of products must take place within 90 days from the original shipment date in order to receive a replacement. All products being returned must be returned in the condition received by you with all original packaging, accessories and/ or manuals.
7. Returns received more than one year after date of shipment will not be accepted and will be returned to sender.
8. Faulty Product
8.1 If you receive a product, which is faulty at time of delivery or faults within 90 days, other than by reason of fair wear and tear or misuse by you, please contact Impact HQ Limited directly to arrange the return of the original item and a replacement product to be provided (subject to availability). All returns must be authorised by Impact HQ Limited. Return costs of faulty products to be assessed will be at the expense of Impact HQ Limited. Faulty products must be returned in the condition received by you with all original packaging, accessories and/or manuals.
9. Incorrectly Described Product
9.1 Impact HQ Limited tries its best to present the products accurately. Impact HQ Limited makes no warranty or representation that the information provided by our suppliers in relation to the product description is accurate, reliable and complete.
9.2 If you receive a product which is incorrectly described please contact Impact HQ Limited directly to arrange the return of the original item and a replacement product to be provided (subject to availability). All returns must be authorised by Impact HQ Limited. Return costs of incorrectly described products to be assessed will be at the expense of Impact HQ Limited. Incorrectly described products must be returned in the condition received by you with all original packaging, accessories and/or manuals.
10. Change of Mind – Refunds/Exchanges
10.1 Please choose carefully. We do not provide refunds or exchanges if you have changed your mind or made a wrong selection by mistake. We recommend you carefully preview any orders before adding them to your shopping cart and proceeding with your order. 11. Adjustment of Order Information
11.1 All orders are considered final at time of placement. Please check your details carefully before submitting your order. Should you need to make an adjustment to your order, please contact admin@impacthq.co.nz immediately. Once an order is placed, there is no guarantee that it can be altered or changed in any way however, we will endeavour to accommodate where possible.
11.2 Please note contacting carriers directly is the responsibility of the customer.
12. Tax, duty and customs charges
12.1 Customers located internationally may be required to pay sales tax, duty and/or custom charges.
12.2 All Taxes and customs charges are the responsibility of the customer and are not included in the cost of the order or shipping charge. Taxes and customs charges differ deepening on the state of the shipping address. We suggest contacting your local customs office if you are unsure of the applicable taxes and customs fees that are relevant to you. Impact HQ Limited is not responsible for any additional taxes and customs charges that are requested during the shipment of your order.
13. Goods Damaged/Lost in Transit
13.1 If any goods arrive damaged, please contact us as soon as possible. Impact HQ Limited will arrange to have the damaged goods returned to our office or manufacturer and a replacement of the product to be provided (subject to availability). Damaged goods must be returned in the condition received by you with all original packaging, accessories and/or manuals. You must notify Impact HQ Limited of the damage within 48 hours of delivery providing full details of the damage along with your order/invoice number.
14. Liaising with the Manufacturer
14.1 For some product replacements, the manufacturer will liaise with you directly. We will provide the relevant manufacturer with your contact and product details.
14.2 The New Zealand Consumer Law provides that products which we supply come with guarantees that cannot be excluded. You are also entitled to have the product repaired or replaced if the product fails to be of acceptable quality.
14.3 For some products, the manufacturer may offer their own optional or additional warranties and these apply alongside your rights under the New Zealand Consumer Law.
GENERAL TERMS AND CONDITIONS
15. Minors
15.1 Impact HQ Limited does not provide services or sell products to children. If you are below the age of 18, you may use or purchase from our website only with the permission and/or active involvement of a parent or legal guardian. If you are a minor, please do not provide us or other website visitors with any personal information.
16. Risk
16.1 Title of the purchase will pass to you on receipt of full payment from you or when you receive the purchase, whichever happens later.
16.2 Risk of loss or damage to the purchase will pass to you when we provide the purchase to a third party for delivery of it to you and we provide no estimate as to time of delivery and you agree that time is not of the essence with respect to delivery.
16.3 Where we send you the purchase by email delivery, and you claim that you have not received such delivery, then you must contact us at admin@impacthq.co.nz within 7 (seven) days of the date by which you placed the order for the purchase to investigate your claim.

17.1 We are not a medical organisation and Impact HQ Limited do not and cannot give or purport to give you any medical advice or assistance in any form. Nothing in the Website or anything associated with it should be taken or understood as medical advice or assistance nor should it be interpreted in substitution for any medical advice or assistance or used or referred to instead of seeking appropriate medical advice or assistance from qualified practitioners for your particular circumstances and

Impact HQ Limited encourage you to seek appropriate medical advice or assistance before embarking on any use of the Website and/or its products or services.
17.3 You agree that Impact HQ Limited or any of its affiliates, service providers and/or suppliers, warrant or make any representation about the contents, products, services or offers referred to in the Website, and specifically do not make any representation about the risks, results, reasonableness, or accuracy or otherwise of such contents, products, services or offers and your use of the Website, the Impact HQ Limited Online or In Person Workouts and Training Programs, or its products and services, is at your sole risk.

Subject to the rights granted to you by statutory consumer protection legislation, which cannot be excluded, in no event shall we be liable to you for any injury, or incidental, undue damages, whatsoever including damages for loss of income, data, or personal injury or consequential damages except to the extent such limitation or exclusion of liability is not permitted by law.
